Donte' Stallworth's lawyer and Miami police are reportedly negotiating the terms of Stallworth's surrender.

Stallworth is facing a possible DUI manslaughter charge, which would carry a 15-year jail sentence if Stallworth is convicted. Miami's WSVN reports that even with a plea deal, a manslaughter conviction would still carry mandatory jail time. Stallworth's blood test results are due on Friday, and three separate sources are already reporting that he was over the legal limit.Source: Cleveland Plain Dealer

He should get about 15 to 20 years, and turnover 100% of his assets to the family of the man he killed.
Our criminal justice system still doesn't punish drunk drivers the way they ought to be.

The most he can possibly get is 15 years, and if he has no prior "bad acts", which means other DUI incidents, it's more likely the max he will get is 5. Pretty good chance he gets probabtion if it's his first offense.

But, at least we know he's grief stricken. We should worry about he feels, he's got to feel really bad. Don't want to make it worse for him...

The question is - will this be a wake-up call to ANY of the other "I'm Superman and can do whatever I want with no consequence" big shot/big money athletes? There seems to be the feeling that because of their fame and money, they can get out of anything ...

... but a man is dead. No amount of money will make that family whole again, and hopefully that will be a SOBERING thought to those guys that think they can't be touched.

If he has a couple previous DUIs on his record, he might be eligible for the 15 years as a max. Maybe.

Drunk driving isn't exactly a right, but we don't look at it all that harshly. It's just people making a mistake.

I say it's time to make an example.

Start giving the max and see if anything changes.

No he was a good guy and didn't have any priors. You did it...max sentence.

So what do you do for the assholes that have priors and try to flee? Same sentence?

The answer to me is we need to start treating peole who get drunk and drive the same as people who load guns and shoot them at people.

Instead of a good old boy, aw shucks, not trying to hurt anyone, just a silly mistake, psuedo right.

He was drunk. People usually don't know exactly what the hell they're doing. I have a hard time giving someone who is so drunk they kill someone much "credit" for it. And in fact, when people can think even partially clearly, they often stop because they know if they run they will get in even more trouble. It's as much a self serving interest as a benevolent one.

It was 7 AM in Miami on what I assume was a pretty busy street. He really had no choice but to stop/stay. I'm sure there were some (if not plenty) of people that saw it.

Donte Stallworth has returned to Cleveland and has been working out in the Browns' voluntary offseason conditioning program while police in Miami Beach continue to probe his involvement in a fatal car-pedestrian accident, The (Cleveland) Plain Dealer reported.
Stallworth's attorney, Chris Lyons, told the newspaper that Stallworth returned to Cleveland earlier this week.

"Donte reported to the Browns on Wednesday morning and he's been welcomed back by everyone -- his teammates, the management, the coaching staff, and they've all been extremely supportive," Lyons said, according to the report. "It's been good for him to get back to work."
Police in Miami Beach said they are still awaiting toxicology results that could result in criminal charges against the wide receiver, the newspaper reported. Police said it was unlikely they would receive the toxicology report during the weekend, meaning any charges against Stallworth might have to wait until Monday or Tuesday at the earliest, according to the Plain Dealer.
In the meantime, police are continuing to refute South Florida-area media reports that test results showed Stallworth's blood-alcohol level was above the Florida legal limit of .08 percent.
"Right now, we don't have the results and we don't have anything to release," Miami Beach police officer Deborah Doty said, according to The Plain Dealer. "There are a lot of rumors going around and it's unfortunate. People have to respect that there is a person who is deceased."
Lyons said Saturday that neither police nor the state attorney's office have released the results of toxicology tests, and neither has said specifically when they will be released.
A Miami Beach police spokesman didn't return an e-mail or phone message from The Associated Press on Saturday.
The Miami Herald and local TV news outlets, citing unnamed people, have reported that Stallworth's blood-alcohol level was above Florida's legal limit.
Stallworth has not been charged with a crime in the death of Mario Reyes, a 59-year-old Miami man who was struck by Stallworth's Bentley on a Miami Beach street early the morning of March 14.
"My family and I are grief-stricken over the tragic accident which occurred Saturday on Miami Beach where Mario Reyes sadly lost his life," Stallworth said in a prepared statement released earlier in the week by the Browns. "My thoughts and prayers are with the Reyes family during this incredibly difficult time."

Lyons said he has remained in close contact with Stallworth and that police in Miami Beach are aware of Stallworth's whereabouts, according to the Plain Dealer.
"He's going to stay up there and keep working out and getting himself in the best condition he can," Lyons said, the newspaper reported. "At the same time, Donte and his family have been respectful of Mr. Reyes' family, and he's always mindful that Mr. Reyes lost his life."

The Browns are not likely to recoup Donte' Stallworth's $4.75 million roster bonus even if he is ineligible to play in 2009.
Stallworth received the bonus the day before he hit Mario Reyes while drunk in his Bentley and killed Reyes. The bonus was guaranteed. Stallworth still has not been charged with a crime, but the Browns likely are out of luck.

ORCHARD PARK, N.Y. (AP) -- T.O. was a no-show Monday for the start of the Bills voluntary offseason conditioning program.

Yeah, they're voluntary, but you'd think being new to the team he'd make the effort to show up and get to know his teammates/coaches.
