Yep - I figured he straddled the line pretty well. I almost replied and reminded him that he doesn't have to hope - he has the magic wand in his hand to make it happen, but I figured that would get me close to pest status and get me on the blocked e-mail list. :o)

Maybe he's gotten quite a few pushes to let Mbakwe play. The current policy stinks.

This time the judge had a conflict with his schedule. Not much you can do about that. According to the Pioneer Press, Maturi has said that if the trial keeps getting postponed he may allow Trevor to play. About a year late with that call.

That's exactly what I told Maturi in the e-mail I sent him (copied it here). That Mbakwe was not being well served by the justice system with delay after delay after delay. I said he needs to let him play while this gets sorted out. I hope that's the track he takes.

This July date has been there for a couple of months and he waited until 2 weeks before to find the conflict? This guy has been gettin pushed back for a year now so why couldn't he change the other conflict?

Looks like Mbakwe's case is settled. He will enter a pre-trial intervention program and do community service. My only disappointment is that the settlement means he has to accept a punishment - while all along it certainly appeared that he wasn't even in the same state as the victim. I guess Mbakwe and his family decided that this was preferable to seeing it dragged out any more.

It will be nice to see him play this year.

This eliminates any risk no matter how small that he would be found guilty. The prosecution knew that they didn't have a case and stalled it out to get him to agree to something. This deal is only one step removed from the DA coming up empty handed.

The DA needed to take a big gulp and admit they didn't have a case and drop the charges. But oh well, nothing any of us could have done about it.

Haven't seen the guy play personally, but from all reports he will be perfect in a rotation with Iverson and Sampson in the 'big' positions.  Each bring something different to the table.

From the Pioneer Press article this morning:

Samms said Thursday that the prosecution was also responsible for many of the continuances. He said that before the last delay in July, the state attorney's office approached his client with the intervention program option. But the victim wouldn't approve it, so the case was headed to an Aug. 23 trial.
"When they met with the victim this time and explained to her they weren't going to win the case, they made the offer again," Samms said.
The program isn't usually offered to violent felony cases such as assault, Samms said, meaning that the prosecution's case was "falling apart." Samms said Mbakwe looks forward to doing his community service and counseling in Minnesota, and getting it all behind him.

The prosecutors are trying to make it sound like Mbakwe's lawyer kept pushing for the continuances and they finally had to offer this deal because the victim wanted to get it over with. According to Mbakwe's attorney

But Gregory Samms, Mbakwe's lawyer, said the prosecutor offered the pretrial program after learning that an officer who interviewed the accuser in the case told her to "bolster her case" by falsely claiming that she knew Mbakwe prior to the alleged assault. - startribune.com

Samms also said the prosecutor and accuser agreed to that option because of the holes in their case against Mbakwe.
For instance, legal documents say that the victim described her assailant as a 190-pound, 6-6 black man. But Samms said the accuser told him that she never gave police that information.


He also said the pretrial program Mbakwe will enter is usually employed by people facing misdemeanors.
"The truth of the matter is their case kept getting weaker," he said.

I'm surprised they even accepted the offer. The DA and the police department were set to get their asses handed to them.

It would be sweet to see that DA investigated for some kind of bad practice. No idea what the charge would be, but it sure seems like he broke some laws.
